Company Found Guilty of Exposing Employees to Asbestos

During the course of the work, workers discovered asbestos fibres in the ceiling panels. Though the company was in possession of the presence of asbestos report by the HSE, it chose to ignore it and take up the Amdale Centre job.

Workers were exposed to unnecessary risk of asbestos exposure despite prior knowledge. Asbestos exposure has contributed to over 4,000 work-related deaths per year in the UK. The company was fined £4,000 at Trafford Magistrates’ Court after it pleaded guilty to breach under Control of Asbestos Regulations 2006 and the 1974 Act of Health and Safety.

Eastern Regional Shopfitters Ltd was charged with breaching Regulations 5, 8 and 11 of the Control of Asbestos Regulations 2006 by failing to carry out a suitable assessment of the asbestos, carrying out asbestos removal without a licence, and exposing workers to asbestos. It was ordered to pay an additional cost of prosecution of £3,215.

A costly lesson was the outcome in addition to the fines for violating safety and health precautions. A simple survey report by the HSE had warned potential customers of the threat. However, the shop fitting company blatantly ignored the report and put the health and safety of workers to risk.
